"Seller" refers to the user accessing or registering with the website/mobile application for creating its store in the website/mobile application and offer various products and services from the website/mobile application;

"Website/mobile application" shall mean and include "https://www.hungertale.com" and any successor Website/mobile application of the Company or any of its affiliates;
"Customer Account" shall mean an electronic account opened for the customer for purchasing products and availing various services offered on the website/mobile application;
"Seller Account" shall mean an electronic account opened by the user with the Platform to sell its product and services through the platform;
All references to the singular include the plural and vice versa and the word "includes" should be construed as "without limitation".
Words importing any gender shall include all the other genders.
Reference to any statute, ordinance or other law includes all regulations and other instruments and all consolidations, amendments, re-enactments or replacements for the time being in force.
All headings, bold typing, and italics (if any) have been inserted for convenience of reference only and do not define limit or affect the meaning or interpretation of the terms of this Agreement.
Scope: These Terms govern your use of the Website/mobile application and the Services. Except as otherwise specified, these Terms do not apply to Third-Party Products or Services, which are governed by their own terms of service.
Eligibility: Certain Service of the Website/mobile application is not available to users under the age of 18 or to any users suspended or removed from the system by us for any reason.
Electronic Communication: When you use this Website/mobile application or send e-mails and other electronic communications from your desktop or mobile device to us, you are communicating with us electronically. By sending, you agree to receive a reply communications from us electronically in the same format and you can keep copies of these communications for your records.
At hungertale.com, we provide you an online platform to buy and sell homemade food along with the option to make online payment via secuared online payment gateways and use the delivery service with our delivery partner(s).
Sellers are responsible for ensuring the quality of the food item.
We reserve the right, in our discretion, to change, modify, add to, or remove portions of the Terms (collectively, "Changes"), at any time. We may notify you of changes by sending an email to the address identified in your Account or by posting a revised version of the Terms incorporating the Changes to its Website/mobile application. Your continued use of the Site following the posting of changes will mean that you accept and agree to the Changes.
We act as an aggregator between Buyers and Sellers and provide services that have been designed to save your time and money. We strive to provide you with the information you need to make an informed choice on which provider of service best suits your needs.
We accept no responsibility for any loss, damage or death happens during and after the service. Seller shall indemnify us for all claims and liabilities arising out of any use by the Seller of the Website/mobile application, including costs and expenses incurred.
For accessing the website/mobile application and using certain Resources, you may be required to provide specific information and to create a user ID and password to establish an account.
You accept that the details you provide about establishing an account are correct and that you will keep your details up-to-date. You are responsible for the security of all of your user names, passwords, and registration information (such as unique account identifiers or historical billing information), and you are solely responsible for any use (authorized or not) of your accounts. sends repeated messages related to another user and/or makes derogatory or offensive comments about another individual or repeats prior posting of the same message under multiple emails or subjects.
Any submitted content will be refused by us. If repeated violations occur, we reserve the right to cancel user access to the website/mobile application without advanced notice.
All the purchases from this website/mobile application shall be governed by our terms and conditions.
If you make an Order for buying any product from our website/mobile application. At the time ordering, while providing your details you must be careful and warrant that the details provided are true and accurate.

A refund shall be made as per our Refund policy.

HUNGER TALE PVT. LTD does not set refund on behalf of the Sellers. The Seller shall be responsible for communicating its refund policy to the Customers and to inform HUNGER TALE to issue refund as per refund policy and in accordance with applicable laws. All issues related to refund shall always be between the Customer and the Seller. We (HUNGER TALE PVT. LTD) are not liable for any refund-related claims in connection with Seller and Seller hereby agrees to indemnify, defend and hold harmless the Website/mobile application in connection therewith.
We do not guarantee the accuracy, completeness, validity, or timeliness of information listed by us.
We make material changes to these terms and conditions from time to time, we may notify you either by prominently posting a notice of such changes or via email communication.
The website/mobile application is licensed to you on a limited, non-exclusive, non-transferable, non-sublicensable basis, solely to be used in connection with the Service for your private, personal, non-commercial use, subject to all the terms and conditions of this Agreement as they apply to the Service.
We reserve the right for any printing errors on this site as well as the final sales of products. We do not guarantee that the images reflect the exact appearance of the products as a certain color difference may occur depending on the monitor, photo quality, and resolution. We always try our best to expose the products as accurately as possible.
We shall have no liability to you for any failure to deliver products you have ordered or any delay in doing so or for any damage or defect to Products delivered if caused by any event or circumstances beyond our reasonable control including, without limitation, adverse weather, pandemics, strikes, lockouts, and other industrial disputes, breakdown or systems or network access, flood, fire, explosion or accident.
Order Cancellation: For Cancellation, you can cancel your orders via our online platform in agreement with the applicable conditions and agrrement of seller. Upon cancellation, the refund applies to the product only at our seller’s discretion.
While we try our best to provide you best however due to some uncertain situation, if the recipient receives a damaged product, please contact the seller directly and inform us immediately at our email: info@hungertale.com.
Please send an image of the damaged product along with your Order Number and an explanation of the problem. If the products are faulty through no fault of your own, seller is responsible to replace or refund the affected item/s.
Failure to report damaged/spoilage within 24 hours of receiving the order will be at the loss of the consumer.
QUALITY AND QUANTITY ASSURANCE:
Before the Product(s) being displayed/advertised on the Platform, the Seller ensure the availability of the Products for servicing customer’s orders .
LICENSE TO MAKE USE OF INTELLECTUAL PROPERTY.
The Seller hereby grants to the Company during the Term of this agreement, a royalty-free irrevocable license to use its Intellectual Property to provide the Services by the Company as contemplated hereunder.
In the event, the Seller sources the Products from any Supplier, the Seller shall obtain all applicable licenses and consents for the use of such Supplier’s Intellectual Property in connection with the Product being sourced from such Supplier to provide the Services by the Company, before the display/advertising of such Products on the Platform.
The term “Intellectual Property” shall mean and include logos, trade names, brand names, trademarks, copyrights, and other relevant intellectual property rights relevant to the advertisement and sale of the Products.

We provide an opportunity for you to avail the offered Products and Services from our Website/mobile application.
We do not provide any warranty or guarantee that the products and service descriptions are accurate, complete, reliable, current, or error-free. If a Services offered by the Website/mobile application is not as described, your sole remedy is to intimate us about Services for taking further action.

Sellers are solely responsible for taking all necessary licenses for selling products on the website/mobile application and preparation, and quality checks of Goods sold to the Customers
The Seller shall be required to provide an actual business name for registration on the website/mobile application.
Seller shall indemnify Company for all claims and liabilities arising out of any use by the Seller of the www.hungertale.com Website/mobile application, including costs and expenses incurred.
The Seller shall be liable and responsible for any claim or legal proceeding arising out of the use /sale of fake or Adulterated product by the Seller
The Seller is not an employee of Company and accepts full responsibility for all Income Tax, National Insurance, and other liabilities arising from the use of the www.hungertale.com Website/mobile application.
All information provided by a Seller on the www.hungertale.com Website/mobile application must be accurate and kept up-to-date. This includes the correct name, address, telephone number, and product details. Details entered by the Seller on the www.hungertale.com Website/mobile application will be publicly visible and may appear in search engine results.
The use of the www.hungertale.com Website/mobile application is entirely at a customer/Seller's own risk. A customer must exercise complete caution when using the www.hungertale.com Website/mobile application.
The Seller shall be required to take necessary licenses as per the application law for selling alcoholic products to the consumers.
The Seller agrees and undertakes to fully co-operate with the Company as reasonably required, in connection with any customer-service functions undertaken by the Company. Such services can be provided by the Seller either on its own or through the Suppliers, as the case may be.
The Seller authorizes the Company to place;
description of each of its Products (including but not limited to the technical description of the Products, brand name of the Product, the price of the Product, and any applicable warranty terms) on the Platform.
The Seller rating based on Seller performance and customer reviews.
We take no responsibility for any indirect damage that may result from the product.
We accept no responsibility for delays/errors due to circumstances outside the Company's ruling (Force Majeure). These circumstances can be, for example, labor conflict, fire, war, government decisions, reduced or non-delivery from the supplier.
We shall not be liable and responsible for the behavior of the users (both Sellers and the customers). And we are also not accountable for the quality of the products provided by the Sellers on the website/mobile application.
You understand and agree that we (a) do not guarantee the accuracy, completeness, validity, or timeliness of information listed by us or any third parties; and (b) shall not be responsible for any materials posted by us or any third party. You shall use your own judgment, caution, and common sense in evaluating any prospective methods or offers and any information provided by us or any third party.

SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
TERMINATION
Term. The Services will be provided to you can be canceled or terminated by us. We may terminate these Services at any time, with or without cause, upon written notice. We will have no liability to you or any third party because of such termination. Termination of these Terms will terminate all of your Services subscriptions.
Effect of Termination. Upon termination of these Terms for any reason, or cancellation or expiration of your Services: (a) We will cease providing the Services; (b) you will not be entitled to any refunds or usage fees, or any other fees, pro-rata or otherwise; (c) any fees you owe to us will immediately become due and payable in full, and (d) we may delete your archived data within 30 days. All sections of the Terms that expressly provide for survival, or by their nature should survive, will survive termination of the Terms, including, without limitation, indemnification, warranty disclaimers, and limitations of liability.
ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties hereto concerning the subject matter contained in this Agreement.
DISPUTE
In case there is a dispute between the Seller and the Customer. The Seller understand that Hunger Tale Pvt Ltd is under no obligation with respect thereto, and the Seller hereby releases and indemnify Hunger Tale Pvt Ltd and its affiliates and each of their respective officers, directors, employees, service providers, agents and successors from all claims and liabilities arising out of or in any way related to such disputes.
GOVERNING LAW AND JUDICIAL RECOURSE
The terms herein will be governed by and construed under the Law of Singapore without giving effect to any principles of conflicts of law. The Singapore Courts shall have exclusive jurisdiction over any dispute arising from the use of the Website/mobile application.
FORCE MAJEURE
We will have no liability to you, your users, or any third party for any failure us to perform its obligations under these Terms if such non-performance arises as a result of the occurrence of an event beyond the reasonable control of us, including, without limitation, an act of war or terrorism, natural disaster, failure of electricity supply, riot, civil disorder, or civil commotion or other force majeure event.
ASSIGNMENT
The Company shall have the right to assign/transfer this agreement to any third party including its holding company, subsidiaries, affiliates, associates, and group companies, without any consent of the User.
